The Act of September 29, 2022, on the principles of implementing support programs for entrepreneurs in connection with the energy market situation in the years 2022–2024 (Journal of Laws of 2022, No. 2088, hereinafter referred to as the "Support Act"), introduces the possibility for the Council of Ministers to adopt support programs aimed at providing financial assistance to specific groups of entrepreneurs (hereinafter referred to as "compensation programs"). Assistance is dedicated to entrepreneurs whose business activities are threatened by the dynamic increase in the costs of electricity and natural gas.
The Act defines the framework for government programs adopted by the Council of Ministers through resolutions, which can be implemented in the years 2022-2024. Based on the Support Act, the Council of Ministers adopted the program "Assistance for energy-intensive sectors related to sudden increases in prices of natural gas and electricity in 2022." A total of 208 entities benefited from public aid, with the total assistance amounting to PLN 2.409 billion.
In connection with the ongoing problem of drastic increases in the costs of electricity and natural gas, on October 24, 2023, the Prime Minister signed a resolution of the Council of Ministers amending the program "Assistance for energy-intensive industries related to the prices of natural gas and electricity in 2023." The changes introduced adapt the program to the decision of the European Commission, confirming its compliance with the principles of public aid in the common EU market.
Approximately 3,000 companies are eligible to participate in the program. These are entrepreneurs conducting their business in Poland. The program's budget is up to PLN 5.5 billion. The Ministry of Development and Technology will provide assistance to the companies, and the program will be operated by the National Fund for Environmental Protection and Water Management (NFOŚiGW).
